TERMS AND CONDITIONS OF SERVICE AND ONLINE SALES OF SPORTIVO ASSOCIATION
effective as of: 22.07.2025


§ 1 General provisions

  • These Terms and Conditions (hereinafter: “Terms and Conditions”) set out the rules for the use of the website operated at: http://s-sportivo.pl, including:
    • SPORTIVO Association membership rules,
    • terms of purchase and participation in events,
    • payment and return procedures,
    • Consumer rights, including the right of withdrawal,
    • method of filing and processing complaints,
    • technical conditions for the provision of electronic services.
  • The Terms and Conditions are an integral part of contracts concluded through the service and apply to all users from the moment they start using the services.
  • In matters not covered by these Regulations, the relevant provisions of Polish law shall apply, in particular:
    • Act of July 18, 2002 on the provision of electronic services,
    • Law of May 30, 2014 on consumer rights,
    • Law of September 23, 2016 on extrajudicial resolution of consumer disputes,
    • civil code of april 23, 1964.

§ 2 Details of the Service Provider

§ 3 Definitions

  • Service Provider / Association – SPORTIVO Association based in Szczecin.
  • User – an individual using the services provided by SPORTIVO.
  • Member – an individual who pays membership to SPORTIVO.
  • Event – a sports or cultural activity organized by the Association, the participation of which may require an additional fee.
  • Product / Service – membership, event participation, electronic content.
  • Subscription – cyclical automatic collection of membership fee.
  • Regulations – this document.

§ 4 Type and scope of services provided

  • Through the s-sportivo.pl website, the Service Provider provides services electronically, consisting of:
    • Enabling a membership agreement in a subscription model,
    • Enrollment and payment for events,
    • handling electronic payments.
  • Contracts for services are concluded for a limited period of time (e.g., membership time, event time) and terminate in accordance with the terms of the particular purchase.

§ 5 Technical conditions of use

  • To use the service it is necessary:
    • device with Internet access,
    • A current web browser with JavaScript and cookie support,
    • active email account.
  • The user undertakes to use the service in a manner consistent with the law and good manners.

§ 6 Payments

  • Available payment methods:
    • przelewy24.pl system (BLIK, fast transfer, card),
    • other methods provided on the site.
  • For membership payments:
    • The fee is charged automatically every month,
    • Subscription may be canceled by the User at any time,
    • membership is valid from the first day of the month, provided that both the membership declaration and the fee have been successfully verified by the end of the last day of the preceding month.
  • In case of non-payment:
    • On the first day of the month in which membership was due to begin, a reminder is sent with a 7-day payment deadline,
    • day of the 8th month, if no payment, the User is excluded from membership,
    • The possibility of rejoining – after 20 days of exclusion.

§ 7 Rules for returns and withdrawal from the contract

  • Membership:
    • There is no refund of the membership fee – regardless of the date of cancellation.
  • Events:
    • Return possible only in the case of:
      • cancellation by the organizer,
      • system error,
      • cancellation min. 48h before the start of the event.
    • Return processed within 10 business days.
  • Cooperating entities: The Association is not responsible for the inability to use services and benefits offered by external entities (including Medicover). In the event of termination of the contract, suspension, limitation or discontinuation of services by cooperating entities for the benefit of members of the Association – regardless of the reason for such a situation, the fees paid by members will not be refunded.
  • Withdrawal:
    • The consumer has the right to withdraw from the contract within 14 days if the service has not been performed,
    • Cancellations can be made via email: kontakt@s-sportivo.pl,
    • The service provider returns the funds through the same payment channel within 14 days of receiving the statement.
    • Cancellation of third-party services (e.g., Medicover) of one’s own free will, including failure to activate, failure to use the service, or change of decision by the member – does not entitle the member to a refund of any fees paid.

§ 8 Complaints

  • Complaints related to payment or provision of services should be addressed to: reklamacje@s-sportivo.pl.
  • The application should include:
    • problem description,
    • date of occurrence,
    • contact information.
  • Complaints are processed within 14 working days. Failure to respond within this period means their recognition (in the case of consumers).

§ 9 Protection of personal data

  • Users’ personal data is processed by the Service Provider in accordance with the applicable provisions of the RODO and the Privacy Policy available on the website.
  • In terms of payments, the data controller is przelewy24.pl, operating independently.

§ 10 Dispute resolution

  • In case of disputes, the Service Provider and the User will seek to resolve them amicably.
  • The consumer can use out-of-court dispute resolution methods:
  • If there is no agreement, the cases will be decided by the competent court of general jurisdiction.

§ 11 Amendments to the Regulations

  • The Service Provider reserves the right to amend the Terms and Conditions in the event of:
    • changes in legislation,
    • changes in the way services are provided,
    • organizational or technological changes in SPORTIVO’s operations.
  • The changes take effect 14 days after they are published on the website.
  • A change in the amount of membership fees is announced at least 30 days in advance.

§ 12 Acceptance of the Regulations

By accepting these Regulations, the User agrees to the provision of electronic services in accordance with its content and the Law of July 18, 2002 on the provision of electronic services.
